Design Terms and Conditions

Having a signed acceptance of these Terms and Conditions is not a requirement for them to be valid for any client. If a client pays a Design Fee to accept a design proposal, it will be considered as their acceptance of these terms and conditions. It is important to carefully read and understand these terms before using or purchasing our services. By using our services, you are indicating that you have read and accepted these Terms and Conditions.

Confirmation of a design commission occurs upon receipt of the Design Fee payment by Landscape Design Group. Commencement of the design process and confirmation of a Site Survey booking date follows the receipt of this payment.

Cancellation
As a Client, you are entitled to cancel our services within 14 days of accepting the design commission. In order to cancel, you must provide us with written notice and your cancellation will be considered effective upon our acceptance of such notice. If you cancel before we have conducted a Site Survey, we will provide you with a full refund within 14 days of accepting your cancellation notice.

Landscape Design Group reserves the right to cancel the Service at any time.

Suspension of services
If any of these terms are not met, Landscape Design Group reserves the right to suspend any or all of the Services provided to you, even if they have already been paid for.

Charges and payments
The cost of our Services will be provided to you in your consultation and/or invoice for the Design Fee payment. Payment is required in full unless otherwise specified. We cannot schedule or begin any work until the Design Fee has been received. Should you require additional services at any point during our agreement, you are welcome to request them. We will inform you of any related fees, and if you agree to these additional Services, you will be responsible for paying the incurred charges.

Refund Policy
In case you are dissatisfied with the quality of our work at any stage of the design process, you are free to inform us. However, please note that once a Site Survey has been conducted, we generally do not provide refunds for services rendered or time spent.

If a refund request is made after a Site Survey has been conducted, a fee of £1097 ex VAT will be charged for the Survey, which will be deducted from the refund amount.

If a refund request is accepted after design work has been carried out, Landscape Design Group may charge for the time spent on the design. The charges incurred will be deducted from the refund amount.

Changes
Landscape Design Group will engage in consultations with the Client during the design process and take into account any proposed modifications to the Design prior to its finalization.

The design commission covers 6 hours of design time for alterations. Landscape Design Group may, at our discretion, make additional non-billable adjustments. However, if changes exceed 6 hours, we reserve the right to charge for extra design time. We will discuss and agree upon any additional charges for design time before starting any such work.

Copyright
The ownership of data, files, and artwork provided by the Client will remain with the Client, but Landscape Design Group is granted permission to use and publish such material. If any copyrighted material belonging to a third party is used, the Client must obtain permission and rights to use such material.

The Client is also responsible for granting permission to Landscape Design Group for use of the same and agrees to protect and compensate Landscape Design Group from any claims arising due to the Client’s failure to obtain appropriate copyright permissions.
All sketches, scale plans, 2D visuals and models, and 3D visuals and models produced by Landscape Design Group will be subject to our copyright and intellectual property rights unless otherwise stated in writing. The Design will remain our exclusive intellectual property until the design process is complete, and full payment of the Design Fee is received. If payments are overdue, all design work created by us will continue to be our sole intellectual property.

Indemnity
By using any of our services or facilities, you acknowledge and assume any associated risks, and you also agree to defend, indemnify, and hold Landscape Design Group harmless from any claims, costs, demands, losses, and liabilities arising from your use of our services or facilities. This indemnification includes all aspects of design work completed by Landscape Design Group.

General
All previous representations, understandings, and/or agreements are superseded by these Terms and Conditions. In order to ensure the quality of our services to our Clients, we reserve the right to modify these Terms and Conditions and the scope of our services at any time.

Notice
All notices must be in writing via email. info@landscapedesigngroup.co.uk

Notices to the Client will be considered validly given if addressed to your address.
​
Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the Agreement shall not be deemed void solely for that reason. A valid, legal, and enforceable provision shall replace any such invalid, illegal, or unenforceable provision, which will be mutually agreed upon.

Landscape Design Group shall not be liable for any loss, damage, or expense arising out of or in connection with any third-party services or contractors hired by the Client to implement the designs provided by Landscape Design Group. The Client acknowledges that they are responsible for ensuring that all work carried out by third-party adheres to up -to date regulations and best practices of construction.
